Ever been busted cruising public restrooms?

Lately I've been enjoying lots of under-stall blowjobs in public restrooms but after getting one tonight I had a little rush of paranoia about the whole deal. I'm wondering if anyone's ever been busted doing this and if so, how it went down. I can see how a cop could pretty easily entice you to stick your cock under that wall, then pop you for it. Never been busted for that, but have heard stories from buddies who have. Usually, it's just security, not actual law enforcement and they threaten you with lot's of stuff.

Just let the guy in the other stall pop his hard dick under first.

Haven't been busted in a restroom... HAVE been busted in a park.

Worse: my dick wasn't even out. I didn't solicit anyone for sex, either.

If you think you HAVE to make any certain move to get busted, think again.

"Loitering" is a terrific catch-all for the police. They can use it to bust cruisers with relative ease. Slap a loitering charge on you in lieu of anything else, just because they KNOW what you are REALLY doing.

Don't think you can easily get away from store security, either. While many security guards are NOT police, and while you may be able to legally walk away from them, there are two things to consider:

When the situation happens, usually you are so shocked and humiliated that you tend to follow along. Running away from a man with a gun, even if he is not a cop, is usually not a great idea -- and usually not something most guys even bother to consider. You can try, though, I suppose. Maybe he'll chase you down. Maybe not.

Even if you are "only" busted by a security guard, depending on the place where you are caught, it is highly likely that there are REAL undercover cops there, patrolling for shoplifters. It won't take them very long to get to where the guard has you detained. And once in the custody of a real cop... you're screwed.

I got busted once for looking at a guy in a hotel room window on the third floor as I stood on the beach and watched him give me a jerk off show. He knew I was watching and stood by the window jacking his dick. I did nothing, but I was THERE.

As it turns out, a Florida Fish And Game Warden was ALSO staying in that hotel. He saw me out on the beach, watching. He never saw the masturbator. So he took it upon himself to come out and get me.

In his uniform, I thought he was an actual cop. As it turned out in the end, I could have left him at any time, so said my attorney. He had no authority to hold me. My attorney called him a "Turtle Counter." Yet the "officialness" of his uniform made me think I HAD to listen to him.

So I stayed there with this asshole Turtle Counter while he called the REAL police. This took about half an hour. I COULD have left, but didn't. Once the REAL police arrived... oops! Too late.

Keep that in mind.

Finally... store security is just ONE possible way to get busted. When a tearoom becomes problematic for a business, sometimes they call in the vice cops to clean it up for them. In this case, you just may wind up hitting on an undercover cop right from the start.

I understand the thrill of tearooms; I fiddled around with them many times when I was much younger. It's not a scene I am brave enough to attempt anymore, however (with VERY rare exceptions which have always happened accidentally -- sometimes something just comes up... I never look for it, though). So I sure don't have any moral objections to tearooms, even though some gay dudes look upon them as the "lowest" form of gay sex. I do, however, happen to think they are possibly one of the most dangerous places to attempt sex. Essentially, you are very well trapped in a tearoom with little room for escape. This is not to say the cops probably won't be able to catch you anywhere else, too... but that in a tearoom, you're inside, surrounded by four walls, and there's the possibility that if you get caught in a sting, LOTS of undercover cops will be waiting just outside the door.

But then again... I never got busted in a tearoom. Being outdoors didn't seem to help when a dozen cops swarmed around me for doing nothing more than smoking a cigarette after hours in a gay park! You're also listening to an old fart reminisce here, so take it for what it is worth. It is my opinion that in the "olden days," tearooms were more ignored than they are today. Today, tearooms are quickly recognized and shut down FAST. The more active it gets, the more likely that the cops will show up sooner rather than later.

It's easier to have an excuse for "loitering" outdoors in a place where loitering is pretty much a given: public parks are more or less MADE for loitering, right? Public restrooms... not so much! Though this fact didn't help ME out, did it?



I'd stick with the bookstores and outdoor spots if I were you. But use caution no matter WHERE you are cruising, obviously.

PS -- It's an election year. This MATTERS. Crackdowns often reach a fever-pitch the closer we get to an election, especially if you have a lot of new candidates locally. Do consider this. Maybe you'll want to curtail tearoom visits until the holidays...

people definately get busted doing this. back in my student days i did have a cop who played "tap foot" with me and then did a backround check on me. universities often prosceute no-students while giving students a pass when this happens on campus. even though it has been a long time since i've had any tea room activity, every time i enter an new one there is still a little rush as to what i may discover.

I have more to say about being busted, I was interrupted yesterday.

I was busted in an Atlanta park in 1990 and charged with public indecency, later changed to a charge of loitering. I was sitting in a parked car with a guy that had his dick out. I was in his car about 10 seconds when I realized that this wasn't the guy I wanted to be sitting with, as I was getting out a guy walked up, showed a badge and I was handcuffed.

As bad as the situation was I gotta say the cops treated me pretty good, better than they treated the guy that had his dick out. He was a fem guy and was crying like a baby. They never gave him a chance to put his dick back in his pants and when we were hauled away in the cop car his dick was still hanging out. At the jail I was put in a room and told I would be out in a few minutes, and I was. The other guy was put in a cell with what looked like a bunch of axe murderers and I later found out he was there all night.

Not Gay Friendly

Just to emphasize GWT's point: Atlanta, including the city itself, is not gay friendly. Despite the fact that there was a lesbian city council president and gays are supposedly considered an important part of the community, the city management does nothing to control the harassment and gay-bashing that goes on by the Atlanta Police. There was a cruisy spot (Dutch Valley for you GWT) that had three sex clubs in an industrial park area -- no residences. The police were in and out of there all the time harassing people. One night, a police officer pulled in on that street at sat there literally for four hours. One of the highest crime rates in the nation and the best thing they could find for him to do was sit on a street to prevent street cruising.

And the rest of the Atlanta area isn't any better.

Clarification of Security Officers

There are severals points that need to be clarified about store/mall security officers. First, store/mall security officers are not law enforcement officers. A store/mall security officer may detain a person from leaving the premises, but they do not have the legal authority to effect an arrest. Just remember that a store/mall security officer is an employee of the store/mall and has no legal authority to arrest anyone. There is one exception to this -- some law enforcment officers often moonlight as store/mall security officers. If this is the case, the moonlighting law enforcement officer may effect an arrest in their capacity as a store/mall security officer upon probable cause. Second. If you are detained by store/mall security for any reason, you may leave the premises on your own accord because store/mall security doesn't have the legal authority to effect an arrest. If a store/mall security officer attempted to effect an arrest without the legal authority to do so, the store/mall would be liable for false arrest. The point here is that detaining someone is not effecting lawful arrest. Third. If a person is detained by store/mall security until competent law enforcement arrives, do not ... repeat ... do not say anything to the store/mall security. If detained, you are not obligated to identify yourself if asked by store/mall security and you are not obligated to produce any identifying documents such as a driver's license or other such identification to store/mall security. The only thing a store/mall security officer can do is to detain a person. They do not have law enforcement authority to effect an arrest unless they are in fact a competent and recognized law enforcement officer.

The problem some people face with being busted in a public restroom in a store/mall is that most do not understand that being detained is not the same thing as being lawfully arrested. An arrest can only be effected by a duly authorized law enforcement officer (i.e., Sheriff, City Police). Since detaining someone is not lawful arrest, you may leave on your own accord unless you are physically restrained from leaving the premises. In that case, physically restraining someone from leaving the premises would constitute arrest. This would be illegal because store/mall security do not have law enforcement authority to effect such an arrest. This is an example of the legal "brightline" distinction between lawful detention and lawful arrest.

Of course, there is always the personal embarassment of being busted, detained and possibly arrested upon probable cause -- all for the want of some tearoom sex. I have to wonder aloud whether the risk of personal embarassment, humiliation, public exposure, and possible arrest is worth it all. I guess there will always be those who believe the risks are well worth the effort and the intangible benefits of public tearoom cruising. Go figure.

I identify myself as an "old fart" probably mostly for the entertainment value of it -- I know there are lots of gay youth who read these boards, and I think that sometimes it can be helpful to someone reading another man's opinion to know that the "old fart" in question is speaking from experience, as well as the cumulative knowledge that comes from age alone.

"Old enough to be my older brother" is actually kind of hot, though not in any sort of incestuous fantasy kind of way. I'm most attracted to men in their thirties and forties. Any guy under twenty-one... HUGE turn off. Though I can't lie: a few dudes in their mid-twenties have been hot, but only for pure sex and a subsequent boot out the door. If a guy isn't old enough to have seen Star Wars in an actual THEATER when it first came out, odds are good I'll have nothing in common with him.

I thought I gave a good example of how store security, provided they are not a moonlighting police officer, have no authority to arrest anyone, but BMG clarified that a bit more. Even the "Turtle Counter" didn't have any authority to detain me... but I sure didn't have the guts to just leave.

I'd imagine most men who have been detained in such a fashion wouldn't know their rights -- or wouldn't have the balls to just leave even if they did. And, as I mentioned... since most high-profile stores not only have security officers on staff, but also usually have a REAL cop trolling undercover for shoplifters... odds are VERY good the REAL cop will be summoned to make a REAL arrest LONG before anyone could get away. Plus the chances of getting caught in a sting set up by real police is very real, too.

Anyway, interestingly... ONE time when I was busted the cops were also VERY nice to me. HOWEVER... there is something you should know about this tactic: sometimes, by being NICE, the cops get you to give up information. If they are friendly, you are more likely to talk and maybe even admit to guilt. DO NOT FALL FOR THIS! BMG gives good advice -- you don't need to say ANYTHING AT ALL. Now, if detained by store security, you need not give any information about yourself. But if actually arrested by a real cop, you DO need to give the basic information. This includes name, address, etc. Contrary to popular belief, you do NOT have to tell where you work, what your religion is, give out names of family members, etc. Lots of guys do this anyway: I was one of them. BAD mistake. Not only that, but I admitted guilt, even though twice I wasn't actually guilty of any sexual crime! Sometimes you say what you think will set you free -- but it won't.

The first cops who were nice to me turned out to know one of my bosses at the time. But even though they were trying to get info out of me, they promised NOT to contact my job. And they kept their word. So I was glad for that. Also, they kind of did something similar to what GWT mentioned happened to him. While I was kept with everyone else who was busted that night (for whatever reason), as we were all being released the next morning, each guy would be called to approach a window where he'd be given back his personal possessions and issued an appearance ticket with a court date. The cops behind the window were making horrible comments to each dude, saying whatever they could about his crime to embarrass him in front of the other cops and "criminals" (also, criminals without the quotes). Now, being humiliated in front of cops and crooks you'll never see again -- not the end of the world, but it was just this bullshit, macho game the cops were playing. The two cops who busted me had told me they would tell the cops at the jail to be nice to me (assuming because they knew my boss or whatever). So when it was my turn to be released... they said nothing at all. I got my stuff back, was given my court date, and that was it.

HOWEVER... the incident with the Turtle Counter was nothing like this. This guy was an asshole. The cops who showed up included some lesbian CUNT who was a real man-hater. Especially a GAY man-hater. She put on rubber gloves to search my pockets, saying: "You're so fucking disgusting I don't even want to touch you." Nice... You puss-sniffing bitch! This based on the fact that I was watching some dude jerk off. I guess that meant to her that I must have crabs or something. Later, asking me questions while booking me, she wanted to know my religion. I told her I don't subscribe to ANY religion. She didn't like this. She said: "Not a God-fearing man, huh? You pig." Or something close to that, anyway.

What a bitch!

In the end, I also accepted a reduced charge and paid a small fine and that was that. But this whole process takes MONTHS. The judge was cool. He was bored to death that day, I could tell. The only thing he said to me was: "Clean it up, will you?"

Maybe three or four months later, I was in Applebee's having dinner, and right in the middle of appetizers the same lesbian cop walks in with a bunch of other lesbians. She was seated about four tables away from me. I wanted to leave, but decided that would only give her satisfaction. She noticed me, I noticed her, and it was apparent we both took a few moments before we realized how it was we were familiar with each other. I just finished my meal and left without incident.

Alright, I'll bite on this one - since I started this discussion I obviously do this sort of thing...

The thing is, I'm married with a kid and consider myself to be pretty much straight (call me bi if you want, I don't care), but I have come to learn that guys give fantastic blowjobs. I've also learned that if I need a quick fix to get off, I can head across campus to a known bathroom, stick my dick under and get sucked off pretty much at will. I mean literally almost every time I go there there's someone sitting there waiting to suck cock. But I'm not attracted to guys. Men who are obviously NOT college students who frequent campus restrooms are usually quite easy to pick out of the crowd. While the guys who are sucking your dick clearly don't mind you being there, it's a good bet that there are some other dudes who wish you'd just go away. Someone who is out of place in any particular environment draws unwanted attention to it. This is frustrating to the regulars who go there -- and is actually considered really poor cruising etiquette.

Go browse around various message boards. You'll find lots of college dudes bitching about older men cruising their restrooms.

Campus "tearooms" are very notorious for the kind of anonymous quickie sex 'mn7in' speaks about. Just about every major university has a few on campus that serve the needs of the student population, school administration, support staff, and the public at large who have access to the campus facilities. Yet, you will also find that the most notorious campus tearoom can be the most risky location to be busted -- by the campus police who are law enforcement officers. Cruising at those campus tearooms is usually AYOR -- At Your Own Risk. Accordingly, 'mn7in' has evidently assessed his own risk and has made a judgment that the 'intangible' rewards or benefits far outweigh the risk of arrest, personal embarassment, humiliation, and public exposure for a sex offense. Given the fact he is married and has a child, the risk of being arrested and charged with a sex offense would probably have more far reaching consequences such as public exposure, with his family and employer learning about his tearoom behavior in the most conspicuous public way. It would be irrelevant to the most decerning person that 'mn7in' considers himself straight if he is busted in a campus tearoom engaging in any form of sexual activity with another male. My point here is that unsuspecting friends, relatives, wives, children, co-workers and employers are exactly those discerning people who might make another judgment when someone is publicly exposured for a sex-related offense.

I guess, for some people, the risks really do far outweight the intangible benefits of tearoom sex. No surprise there. It happens all the time.

Mn7, in his original post, states that he always tries to be as careful as possible while cruising in a public restroom. One thing to keep in mind is that vice officers, cops, security officers etc. have been known to lie. Regardless of how careful you are it is not uncommon for officers to entrap people by masturbating, inviting one to engage in sexual activity or actually instigating physical contact. When this happens the victim has little or no recourse. It is the word of the "cocksucker" vs. the word of the "respected public servant."
