Child Pornography Legal Issues

Here's the deal...I happened upon a Yahoo / E-Group that clearly features pix of under aged boys. My questions are these: What constitutes child pornography? Is it merely nudity of under aged persons? Do they have to be enganging is solo sex or sex with another person? Is one breaking the law simply my viewing such material? I'm not a pedophile but I'm fearful that by joining the group and opening a few of the messages with what appears to be illegal pix has already deemed me "guilty" of accessing child pornography. Are there any legal eagles out there who can answer these questions? Thanks in advance for anyone's help.

MAN, I WOULD ADVOID, DO NOT USE, DO NOT GO THERE,STAY AWAY, GET THE POINT! I don't like child porn, and the justice dept and FBI follow porn trails all over the world. best advice is to stay away. getting caught is a good and easy way to get you 15 seconds of fame and your picture in the paper. down loading child porn is a major no no.

thanks for the input. But I still don't know exactly what constitutes child porn. Please define it if you can. Is it just nudity, or do they have to be engaged in sex (either solo or with someone)? Or, is it just about an erection? Please define. And, is opening a message with an attached pic that automatically open the same as "downloading?"

Unfortunately, downloading is downloading, whether a person opens an attachment online or offline from a message or letter. In order to open an attachment, it had to be downloaded first! But the question of what is child porn is, in my opinion, sometimes tricky. Let's say Mom and Dad notices Little Junior sitting on floor in nothing but his birthday suit and eating out of Fido's food can. They grab a camera and take a picture of this historic event! They develop the film or store the file to a folder in their computer. Of course, this is not a "pornographic" shot, even if Junior's dick and balls were showing clear as day! If the parents had taken a shot of Junior riding his little brother Tim, that could be considered "pornography" because the two were shown performing a sexual act. It doesn't matter if the parents had innocently taken the picture, they could be held liable.... I'm no legal expert, but I do believe that we have to be careful when considering such incidents. About erections: I don't think we can always consider all pictures of boys' erections "pornographic." Again, using our model parents as examples, Junior and Tim are taking a bath and Dad decides to take a picture of them both in the tub washing each other. For some reason, Dad's picture captured both boys' erections. This is a gray area...if neither boy is in a position to give any impression of sex, then it's not "pornographic." Having an erection will not instantly qualify any picture as "pornography," especially if sexual intent was not at the core of the picture. And finally, nudity itself does NOT constitute pornography. But anytime we deal with images of children, we need to take extra time to think about how we photograph or picture them.... Ordinary everyday shots of children and young people can be both inspirational and uplifting, if we all take the time to shoot them in "appropriate" settings!

My comments are only used here as my subjective answers to your questions concerning "child pornography." I have no interest in children or anyone under legal age, I am very much into other men! I hope that I have been of some help....

I have been hoping that some Lawyer would come on the board and give his spin on this subject, it is a grey area. If there are postings on the E-Groups of underage kids how do they get away with it? Would pictures posted in the Nudist groups be considered Kiddy Porn? Just what the hell is considered Kiddy Porn?

I do know that the feds will arrest a porn site's owner if he uses models that are of legal age but are represented as underage. Also, if a model has a false ID and claims to be of legal age but turns out to be underage, the site is still responsible. I wouldn't fuck with kiddy porn, boys. America is very unforgiving.

in MAss a teacher was found guolty under the mass law that says that it is illegal to have anything that depicts children engaged in sex... this guy had taken hard core porn and cut the faces of children out of store sunday fliers... and pasted them on the hard ore porn... in his head kids were having sex...

now the reason kiddie porn is illegal to possess ( where other "obscene material" is illegal to sell and mail, but fully legal to posess in your own home) is that the gov't wants to do everything it can to deter kids from becoming sex objects... kill the mnarket and no kids get molested...

so to answer a question like a lawyer, it all depends on what your state';s laws are re: what is kiddie porn and what is illegal to access....

my personal advice... is to get the pics out of youre harddrive... IF you are thought to have this stuff, the feds will take your hard drive and read even the things that you simply placed in teh recycle bin... i.e. you deleted the name from the directory, but you did not necessarily write over the data with the gifs/jpegs.
reformat to be fully safe... or do not down load it
