sex in car - someone saw

Maybe I am just being paranoid and you guys will laugh at me, but I was getting carried away (oral sex) in the car late one night and someone saw us and took out his cell phone and presumably called the police. If he gave them my license plate, would this result in some kind of claim being filed against me, or is this the kind of thing the police would just say "ah, we'll look into it" and not doing anything about. It was in Los Angeles.

Normally, I wouldn't be so paranoid, but it so happens that I am already awaiting trial for lewd conduct for an incident which, ironically I am NOT guilty for. Just as I was starting to receive reassurance that my case will go well, I -- yes, stupidly -- did this and so the scenario I imagine is this. Police receive complaint. Police note my license # from complaining guy and trace it to my name. Police see that I am already charged with lewd conduct (trial hasn't happened yet) and add this to my record or whatever. At the trial they say, ah ha! I see you were also seen having sex in your car one night. You are obviously an incorrigible repeat offender and must receive the maximum penalty of the law.

Could any of that really happen?

Are you for real?

If so, I'd first reccommend you seek out some kind of sex addiction help as it seems you've lost control of your actions, hence a pending court date for a public sex related charge and you're still at it. Loss of control is always a sure sign of addiction with anything.

However, I'm assuming you were at a known "cruising" area in the car, and if so, the guy in the next car is probably not dialing up the cops as he's probably there for the same thing.

I do hope things work out for you as I'm not a big fan of law enforcement cracking down on these public sex venues while there are plenty of other criminal issues at hand I'd rather see tax dollars tending to.

Here's a reality check for ya. Ya don't have to practice medicine to recognize a corpse when you see one.

If you got hauled off to jail on one night and you have a future court date for a Lewd Conduct charge, it's not a bright idea to turn around in the interim and risk being caught at a public place with somebody else's dick in your mouth.

I mean, we all like dick once in a while. But ... damn! Right after you got busted in a park for something you say you didn't do?

DC, I can only agree with the others that you seem to be a bit irresponsible.
That being said; it is unlikely that the person actually called the police. Had that been his intent, it would be more likely that he would have done so without your knowledge, in hopes that the police would catch you in the act. I live on a street which runs between Sunset and Santa Monica Blvds. in Hollywood. The female steet hookers bring their tricks to our street from Sunset Blvd., and the males and trannies bring theirs from Santa Monica Blvd. It is not uncommon for my neighbors to try to frighten the tricks by appearing to call the police or by pretending to write down license plate numbers. This is done to scare them enough that they don't come back.

I used to love getting blown while driving (still do)

but I doubt you have anything to worry about. if it was at night, I doubt they could identify you, etc (reasonable doubt)

Wow. I'm surprised at some of the comments related to this post.

Clearly, if our friend could undo his action, he would ... he didn't ask if his actions were smart, he asked for advice on how to deal with the results. (I think ... maybe I should re-read his original post).

And to add to his worries someone mentions the threat of BLACKMAIL? (ScruffyCub, I'm surprised ... although maybe it was tongue-in-cheek and I'm just extra dim-witted this morning) Blackmail is SUCH a remote a possibility, don't you think? Hmmm maybe a telephoto cellphone? (not) But how would they know who to mail the pics to?

Anyway ... this is a Cruisingforsex board that ADVERTISES films of sex in the park, in cars, in T-rooms ... ease up on the guy, he's probably about to wet his pants anyway (<-- NOT in a good way).



P.S. I once had a guy threaten to blackmail me ... I simply told him that if I ever heard from him again that I would have him killed. Funny, I never heard from him again.

Bayshore, I think the comments that "surprise" you stem from the fact that in the past few days several posts by dcfan indicate that he seems to building a portfolio of legal problems related to sex in public.
I doubt that anyone is passing moral judgement on our friend. Rather, they are pointing out that it might be prudent for him to consider the legal ramifications of his actions. Particularly, in light of his current legal situation.

I'm the one who mentioned blackmail....somewhat tongue in cheek, but not entirely. A picture of him with a cock in his mouth and a picture of his car with the license plate clearly visible and you have a perfect set up (read his other post. He is scared shitless his employer and others will find out, but still continues). Don't know about California, but in some states anyone can get registration info for a small fee.

Here in Indiana a while back, a neighborhood group got tired of the johns comming to their street looking for hookers. Started taking pictures and mailing them to the home address. If the wife got the mail first, there was a lot of 'splaining to do (as Ricky Ricardo would say).

I'm not passing judgement. Hell I used to prowl the tea rooms and ABS. But I wised up.

I am not a lawyer, but I dated a law student before. He assured me that a good lawyer will demand that the judge prevent the police from saying anything in court about your other offenses. In a criminal court case you have a right to be judged with only the evidence directly related to the case.

But in practice, a police officer or prosecutor could "slip up" and let a jury hear about your other offenses. Even though the judge will tell the jury to disregard the comment, it will be hard for the jury to ignore it. The police officer or prosecutor has little to lose by "unintentionally" violating a judge's order.

This is why many lawyers will decline a jury trial, especially if they know the judge is honest. Judges see so many of these cases they are not influenced by gamesmanship unless they happen to have an agenda of locking up gay public sex perps. If your lawyer doesn't know the judge, you may be fucked.

I'm not a lawyer or a law student, but I have spent more time in a courtroom than _any_ law student and many lawyers. I can assure you that in some jurisdictions and some circumstances, your past can and will be admissible. If you take the stand, your past can be used to impeach you. And even if you don't take the stand, past actions may be introduced to show a propensity.

Since we are talking about California here, let me cite two very recent and very public examples. In the Michael Jackson case, the kid he settled with years ago was allowed to testify about the accusation even though no charges were ever filed. Second, accusations involving Macauly Caulkin were brought out in court, EVEN THOUGH CAULKIN HIMSELF DENIED THEY HAD EVER HAPPENED. I don't know the rules of evidence in California, but there are two examples that prove it can be done....and not by underhanded means.

Teva, I respect you highly. You've given great advise in the past. But a judge does has a remedy if a police officer or prosecutor "slips up". He can declare a mistrial (I've seen dozens), dismiss the charge with prejudice (meaning they can't be refiled), or even hold the guilty party in contempt. And I've seen many a dressing down, which is very humiliating.

Long live the front bench seat! I've gotten so many bj's in the front seat of a car without trouble that i think i prefer them that way. However, i wouldn't engage in oral sex in a car while it is moving, nor would i ever be caught dead in the back seat with my dick in someone's mouth.
